Federal Judge Mandates Release of Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.
"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her ruling.
The case stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to answer human smuggling allegations, he was held in immigration custody.
In her order, the court pointed out that the government lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

The court challenge center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
